DEMAND A SUPPORTING DEPOSITION

You have a right to demand a Supporting Deposition in Traffic cases in Nassau County, New York.

1. What to Do When You Receive a Traffic Summons
First thing to do is review the simplified traffic summons and note whether all information is accurate or not. If not, make sure not to advise the police or authorities of that fact.

2. Send in Your Not Guilty Plea
If you've decided to plead not guilty, don't use the back of the police form. You don't have to. Make a copy and send it back to them on that or simply send them a letter saying you're pleading not guilty.

3. Demand Your Supporting Deposition Without Using Those Words
Make a formal demand in writing (always keep a copy for yourself) and send it to the administrative court on Cooper Street in Hempstead. Send it first class mail and get a receipt for delivery so you can prove when they received it. Make sure you send it out within 48 hours of receiving the summons.

4. Wait 30 Days to See If They Send You a Supporting Deposition
If they fail to send you back a supporting deposition within 30 days of the date they received your demand, then you can move to dismiss the ticket for failure to complete the process in a timely fashion.
